Bar associations, regional bar association and national bar association
The bar association is a public body of attorneys based on the principle of self-government and engaged in performing professional duties and duties in connection with interest representation.
In the course of doing so,
a) it provides for the protection of attorneys' rights, assists them in fulfilling their obligations and organizes continuing education for them,
b) it adopts regulations relating to legal practice,
c) expresses an opinion in matters in connection with attorneys and their practice,
d) makes decisions concerning the initiation and termination of attorneys' membership in the bar association,
e) registers assistant attorneys, assistant European Community jurists, articled clerks, European Community jurists, foreign legal counsels and law firms, and law firms.
f) it shall set up and operate a national archive on its own accord or jointly with other professional associations.
The bar association shall function as regional associations and as a national association (Hungarian Bar Association).
The organization of the Hungarian Bar Association
The Hungarian Bar Association is a public body and the national organization of attorneys, which has an independent administrative apparatus and budget.
The regional bar associations are the members of the Hungarian Bar Association.
The regional bar association is a public body, which has a representative and administrative apparatus and an independent budget; within its operational area, it fulfils the duties assigned to its jurisdiction in Section 12 as well as in the law and in its statutes and rules and regulations. The operational areas of the regional bar associations shall be the same as the jurisdictions of the Budapest Metropolitan Court and the county courts. Tappear in its namehe jurisdiction of a regional bar association shall appear in its name.
The bodies of a regional bar association are the general meeting, presidency of the regional bar association, disciplinary tribunal, conflict-of-interest committee, supervisory board. In addition to the above, assistant attorneys and articled clerks may create committees of assistant attorneys and articled clerks who are consulted with regard to decisions pertaining to them and the rules and regulations. This rule is needed as the articled clerks and the assistant attorneys are not bar members and they are not represented in the other bodies of the bar. In addition to the bodies stipulated above, committees specified in the bar association's statutes may also be elected.
The bodies of the Hungarian Bar Association are the followings: the plenary meeting, the presidency, the disciplinary committee, the conflict-of-interest committee, the election committee, the oversight committee.
The Act XI of 1998 on Lawyers specifies the competence of the plenary meeting and the presidency, while the Statutes shall specify the duties, powers, activities and procedural orders of the other committees, bodies and officers of the Hungarian Bar Association.
The Plenary Meeting
The plenary meeting is the supreme decision-making body of the Hungarian Bar Association. Its activities, competence and procedurals orders are governed by the Act XI of 1998 on Lawyers and the Statues of the Hungarian Bar Association.
The presidency of the Hungarian Bar Association shall convene the plenary meeting whenever necessary, but no less than once a year. The plenary meeting shall be convened by the presidency. The plenary meeting shall be convened when so requested by at least one-third of the bar association's members.
The plenary meeting shall have a quorum if more than half of the members are present.
A majority vote of the members present (simple majority) is necessary in order to validate the plenary meeting's resolutions, while a two-thirds vote of the members present (qualified majority) is required to adopt or amend the Statutes and rules and regulations.
The presidency of the Hungarian Bar Association
The presidency is one of the bodies of the Hungarian Bar Associations. The tasks of the presidency are defined by law and are related to the management of the bar and to legal remedy proceedings.
The presidency shall consist of the president, vice presidents, secretary general (secretary), disciplinary high commissioner (disciplinary commissioner) as well as the members elected by the plenary meeting. It shall have 25 members unless the plenary meeting determines otherwise.
Officers of the Hungarian Bar Association
The officers of the Hungarian Bar Association are as follows:
b) vice presidents,
c) secretary general,
d) secretary (secretaries),
e) presidents of the standing committees,
f) disciplinary commissioner (commissioners),
g) disciplinary high commissioner.
